Product liability is when any party in the chain of manufacture of a product contributes to the injuries you sustain from that product.
Any of them can be held responsible, such as the manufacturer of component parts, the assembling manufacturer, the wholesaler, and the retail storeowner.
Manufacturers and the above parties also can be liable for products containing inherent defects that injure a consumer.
While products are usually thought of in terms of something tangible, such as a vehicle, their definition has expanded to include:
- Intangibles, such as gas
- Naturals, such as pets
- Real estate, such as land
- Writings, such as navigational charts
The United States Department of Commerce has instituted the Model Uniform Products Liability Act for voluntary use by the states, but there is no federal products liability law.
It doesn't matter whether the manufacturer or supplier exercised great care - if there is a defect in the product that causes a consumer harm, he or she will be liable for it.
A well-known case of product liability was against Bridgestone/Firestone, Inc. in 2001 where the states filed a $51.5 million nationwide settlement for deaths and injuries caused by defective tires.
